Terms of Service

The agreement between you and postyay: your account, connected TikTok accounts, your content, plans and billing, and what each of us is responsible for.

The agreement

These Terms of Service (“Terms”) are an agreement between you and [Company legal name], [Registered address, city, country] (“postyay”, “we”, “us”), for your use of the website at postyay.com and the postyay app (together, the “Service”).

By creating an account or using the Service, you agree to these Terms. Our Privacy Policy explains how we handle personal data, and our data deletion page explains how to delete it. If you use postyay on behalf of a company, you confirm that you may accept these Terms for it.

What postyay does

postyay helps you plan and publish social media posts. You write a post once, choose when it should go out, and we publish it to the accounts you connect, showing each step on the post’s delivery timeline.

Today postyay publishes to TikTok. Other platforms shown on our site as “soon” aren’t part of the Service until we launch them. The same goes for features marked “soon” on our pricing page: they are plans, not promises, and they aren’t part of what you pay for.

Your account

  • You sign in with a one-time code that we e-mail to you. There is no password: whoever controls your inbox can sign in, so keep your e-mail account secure.
  • Use an e-mail address that you own. We send sign-in codes and important messages about your account there.
  • You must be at least 18 years old, or the age of majority where you live, to use postyay.
  • You’re responsible for what happens in your account. If you think someone else got in, tell us right away at [email protected].

Connected accounts and platforms

To publish for you, postyay connects to your social accounts through each platform’s official sign-in (OAuth). The platform’s consent screen shows what you allow us to do, and you can disconnect at any time.

  • Your use of each platform stays governed by that platform’s own rules, such as the TikTok Terms of Service and Community Guidelines. You’re responsible for following them.
  • Platforms decide what they accept, and they can change their rules, limits and APIs at any time. For example, TikTok publishes posts from apps it hasn’t finished reviewing as private (only you can see them). We show these limits in the app, but we don’t control them.
  • We aren’t responsible for what a platform does, such as removing a post, limiting its reach or suspending an account.

Your content

You own what you create and upload: videos, photos, captions and the other parts of your posts (“your content”).

You give us a limited, worldwide, non-exclusive, royalty-free permission to store, copy, process and transmit your content, and to adapt it technically (for example, to a format a platform accepts), only to run the Service for you: to show it to you, to publish it to the accounts and at the times you choose, and to help you when you contact support. This permission ends when your content is deleted from our systems. Copies already published on a platform are controlled by that platform.

You confirm that you have the rights to everything you post, including any music, images and people in it, and that your posts carry any disclosure the law or the platform requires (for example, for paid partnerships).

Acceptable use

Don’t use postyay to:

  • post anything illegal, or content that infringes someone else’s rights;
  • send spam, run fake or deceptive accounts, or manipulate engagement;
  • break a connected platform’s rules or get around its limits;
  • harass, threaten or harm others;
  • probe, overload or break the Service or its security, or access other people’s data;
  • copy, resell or scrape the Service without our written permission.

We may remove content from the Service or suspend accounts that break these rules (see “Suspension and closing your account”).

Plans, billing and cancelling

  • Free plan. The Free plan costs nothing and has the limits shown on our pricing page. If we reduce what Free includes, we’ll tell you before the change applies to you.
  • Paid plans. Paid plans are billed in advance, monthly or yearly, in US dollars. Payments are processed by Stripe; we never see or store your full card number. Taxes may apply depending on where you live.
  • Renewal. A subscription renews automatically at the end of each period until you cancel it.
  • Cancelling. You can cancel at any time from Settings → Plan & billing → Manage billing. You keep your plan until the end of the period you’ve paid for, and it doesn’t renew. We don’t refund partial periods, except where the law requires it.
  • Price changes. If we change the price of your plan, we’ll tell you at least 30 days before it applies to your next renewal, so you can cancel first.
  • Limits. Each plan has limits, such as the number of connected accounts and posts per month. Features marked “soon” aren’t included until they launch.

Support and staff access

When you write to support, a person on our team reads your message. To help you, they can see your account details, your connected accounts (never their access tokens), your posts and their delivery timelines.

If fixing a problem requires it, a staff member can open your account as you (“view as user”). Each time, the reason is recorded, you’re told in your support chat who came in and why, the session ends after one hour at most, and changing billing or disconnecting accounts is blocked while it lasts.

Availability and changes to the Service

We work hard to publish every post on time and to show you exactly what happened when something goes wrong. But the Service depends on the internet, on our providers and on each platform’s API, so we can’t guarantee that every post will be published, or published at the exact minute you chose.

We may change, add or remove features. If we remove something significant from a paid plan, we’ll tell you in advance.

Suspension and closing your account

You can stop using postyay at any time and delete your account yourself in Settings (see Data deletion).

We may suspend or close an account that breaks these Terms or the law, that puts other users, a platform or the Service at risk, or when the law requires us to. Where it’s reasonable, we’ll tell you why first and give you a chance to fix it. If we close a paid account without you having broken these Terms, we’ll refund the unused part of your current period.

Disclaimers

Apart from what these Terms say, the Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement, to the extent the law allows. We don’t promise any particular result from posting, such as reach, views or followers.

Limitation of liability

To the extent the law allows:

  • we aren’t liable for indirect or consequential losses, such as lost profits, revenue, reach or data;
  • our total liability for all claims related to the Service is limited to the greater of what you paid us in the 12 months before the claim and USD 100.

Nothing in these Terms limits liability that can’t be limited by law, such as liability for intent or gross negligence, or for death or personal injury caused by negligence.

Changes to these Terms

We may update these Terms. The date at the top of this page shows the current version. If a change matters to you, we’ll tell you by e-mail or in the app at least 30 days before it takes effect, unless the law requires it sooner. If you keep using postyay after that, the new Terms apply; if you don’t agree, you can close your account before they do.

Governing law

These Terms are governed by the laws of [Country of governing law], and the courts of [City of competent courts] have jurisdiction.

If you use postyay as a consumer, you keep every protection that the law of the country where you live gives you, including any right to withdraw from a purchase and the right to bring a claim in your local courts.

If any part of these Terms can’t be enforced, the rest still applies.
